EMPLOYMENT VISA


It is possible for a person entering Hong Kong as a visitor to
later apply to the HKID for an employment visa by way of
“change of status”. But it is preferable (because the chances of success are higher) to apply from one’s own country, having first obtained the offer of suitable employment in Hong Kong. In the latter case, the application may be made either by the applicant himself through a local Chinese consulate, or directly to the HKID by his prospective
employer in Hong Kong. The documents required by the
HKID in support of an application for an employment visa
are as follows:


(a) a completed and signed application form ID(E) 936, in
respect of the applicant and any accompanying dependants;


(b) passport and proof of temporary or permanent residence
in the applicant’s country of origin;


(c) a copy of the sponsor’s (prospective employer’s)
Business Registration Certificate or Certificate of
Incorporation and/or Memorandum of Incorporation, and
Articles of Association;


(d) proof of the financial standing of the sponsor/sponsor’s
company (income tax return, trading rofit and loss account,
profit tax return);


(e) a copy of the sponsor’s company’s staff list with details
of positions held and salary offered,
and a list of expatriate staff previously or currently recruited
from overseas;

(f) a copy of the applicant’s service contract or letter of
appointment with details of post, alary and other benefits;


(g) details, with proof, of the applicant’s academic
qualifications and experience relevant to he post – e.g. copies of degrees, diplomas, certificates, testimonials etc.;


(h) a letter, with supporting evidence from the sponsor,
stating why the post cannot be filled ocally;


(i)if the applicant is to replace someone already working in
Hong Kong, that person’s personal articulars and
whereabouts (if known);


(j)if the applicant is to fill a new post, an explanation why his
services are essential; and


(k) if applicable, evidence of the applicant’s past residence in
Hong Kong.


In addition to the above documents, the HKID may require
other information and/or documents, epending on the
individual circumstances of the case. Applications for
employment visas are ormally processed within four to six
weeks if submitted directly to the HKID in Hong Kong, but
may take longer if submitted overseas. Once issued, the visa
must be renewed annually for the irst three years, then on a
three-yearly basis thereafter.
